Event summary

Many local authorities have underestimated the time, resources and complexity involved in managing the end of private finance initiative (PFI) contracts, the public spending watchdog the National Audit Office (NAO) has warned in a new report.

This could result in assets being returned back to councils in a worse condition than agreed in the contracts, leading to extra costs for repairs, maintenance and operation falling on already cash-strapped councils, police and fire authorities, NHS Trusts and central government departments.

There are currently more than 700 PFI contracts, with most expiring from 2025. Most, if not all of the in-house experts who were involved in setting up PFIs will have left, taking their considerable local knowledge with them.

Speaker - Ian Gardner

Ian Gardner, MEng MBA AMIMechE CMgr FCMI, has significant experience in the management of Operational PFI/PPP contracts on the Ministry of Defence estate. The portfolio of 12 contracts cover Accommodation and Utility PFI/PPPs with a total annual value of over £600M and initial capital expenditure of circa £3.4Bn. The Accommodation portfolio include major Garrisons providing living, working and training accommodation and include substantial engagement and support with local government and communities.

During this period Ian experience includes driving increased utilisation and major development of PFI contract, this included significant investment in the MOD Head Office enabling the disposal of the Old War Office and St George’s Court; delivery of over £1.3Bn efficiency savings; managing the collapse of Carillion; and implementation of ISO44,001 Collaborative working standards.

He is also leading on the approach for PFI Exit in the Defence Infrastructure Organisation.

Ian is also a regular contributor to the Partnership’s Bulletin round tables and articles.

Speaker - Mark Williams, CPFA FCA, Senior Advisor / Consultant, CIPFA

Mark specialises in the financial and commercial implications of complex projects, including PPPs and PFIs at all stages in their lifecycle. Until recently he led for PA Consulting on Property and Infrastructure. Prior to that Mark was an audit/advisory partner with one of the big four firms, where he set up their government finance and accounting team.

He has worked extensively with HM Treasury and the Cabinet Office, including in relation to PPP/PFI technical guidance and best practice. Mark provided support to both the NAO in relation to their recent PFI exit report, and the Partnerships Bulletin on their roundtable and report on the same subject. In this he drew on experience of PFI operational efficiency work and PFI exit work.

Mark delivers a variety of learning and development to public servants: HMT’s Better Business Case, the World Bank’s PPP training, and Cabinet Office and IPA’s Project Leadership Programme. He is a member of both the CIPFA government board and the CIPFA South East council.

Speaker - Judith Hopper, Partner, Bevan Brittan

Judith is a commercial litigation partner with over 15 years of experience in commercial litigation and contentious construction, including work on a number of reported cases. Her clients come from a variety of sectors and services and include local authorities, central government bodies, healthcare bodies, financial institutions, private companies and shareholders. Judith advises on a wide range of litigation matters, including commercial and contractual disputes, private finance initiative/projects disputes, professional negligence claims, construction disputes, corporate and breach of warranty claims, shareholder dispute and breach of confidentiality claims.

She delivers straightforward and cost-effective legal advice, and regularly deals with all forms of dispute resolution, including court proceedings, adjudication, expert determination, negotiation and mediation. Her aim is to understand her client's business and strategic aims and to implement them in the most effective and practical way.

Speaker - Colin McConaghy, Partner, Bevan Brittan

Colin is a commercial projects lawyer specialising in complex public and private partnerships, energy and outsourcing transactions. He advises on a wide range of commercial contracting arrangements, including ICT outsourcing, back office services outsourcing, energy projects (including energy performance contracting) and facilities management. His experience covers a wide range of complex partnership/private finance initiative sectors, including education, health, leisure, badged services and waste. I have particular experience in structuring and advising on complex contractual arrangements.

He advises on all stages of projects from inception and scoping, negotiation, close and post close. Colin has significant experience in advising on post-close operational matters and has implemented many contract variations (including both high value complex and simple variations). His client base is broad and includes private sector companies, bidding consortia, joint ventures, special purpose vehicles, project sponsors, funders and local authorities.

Speaker - Colin Balkman

Colin is a highly experienced consultant with a first-class track- record as an adviser to both the public and private sectors in the UK and internationally. A member of CIPFA since 1988, Colin started his career in local government before moving into consultancy working for both PwC and KPMG. In the mid-1990s he was seconded to the Government to advise on the development of PFI in local government. He subsequently advised on a number of pathfinder projects in the UK. He has also advised the United Nations on their approach to privately funded infrastructure projects and run training courses for delegates from all over the World on PFI.
